Terms of Service

Witness: Chat Funnels CRM, the website, the app and the Chrome extension

These terms are an agreement between you and LOL Media LLC("we", "us"). By creating an account or using Witness, you agree to them. If you use Witness for a business, you agree for that business too. We wrote them in plain words on purpose. Our privacy policy, refund policy and safety page are part of these terms.

Who can use Witness

Witness is a business tool for adults. You must be 18 or older. You are responsible for what happens under your account, so keep your password safe and use two-step sign-in where it is available.

Your account and your team

Each account is its own workspace. Your leads, numbers, scripts and saved conversations are kept apart from every other account. Managers can invite teammates and turn off their sign-in. Nothing is deleted when someone leaves; their sign-in is turned off.

Plans and prices

Solo: $49 a month.
Team: $149 a month.
Agency: $297 a month.
Coaching programs: priced on their own. We agree on the price with the program.

Prices are in US dollars and do not include any sales tax that applies. If we change a price, we will tell the account owner by email before the new price applies to them.

Plan limits and seats

Each plan comes with limits, like how many people (seats) can sign in to your workspace. The limits for each plan are shown when you pick it and on your Billing page. A seat is for one person. Do not share one sign-in between people. If you need more seats or more room, move up to a bigger plan.

Free trial

New accounts get a 14-day free trial. You need to add a card to start it. If you do not cancel before the trial ends, your card is charged for the plan you picked on the day the trial ends. One free trial per person or business.

Billing

Payments are handled by Stripe. Plans renew on their own each month, and we charge your card at the start of each month you pay for, until you cancel. You agree to keep a working card on file. We never see or store your full card number.

Cancelling

You can cancel any time from the Billing page. Once you cancel, you will not be charged again. You keep access until the end of the month you already paid for. We do not give partial refunds for unused days, except as our refund policy says.

Refunds

If you are not happy, you can ask for your money back within 14 days of your first payment. The full rules are on our refund policypage. If you bought Witness through a marketplace (for example, a lifetime deal), that marketplace's refund terms apply to that purchase.

If a payment fails

If a payment does not go through, we will let you know and try again. You have 7 days to fix it. After that, your workspace becomes read-only: you can still sign in and see your data, but you cannot add or change things until the payment goes through. We keep your data. We never delete an account or its data just because a payment failed.

Your AI key

Witness uses an AI key that you or your team add, from a company like Anthropic or OpenAI. Any charges from that company are yours, and they are not part of your Witness plan. You agree to follow that company's rules. We store your key encrypted and only use it for the AI work you ask for. AI can be wrong. Read what it writes before you use it.

Messages

Witness never sends a message for you. It counts, reads and suggests. You decide what gets sent. The safety page lists what Witness touches and what it never does.

Conversations and the shared pool

Conversations the extension reads are stored encrypted, with names, handles, phone numbers, emails and links removed. When one of your conversations ends in a booked call, that copy helps the reply coach for other users who sell the same kind of offer, and their booked calls help yours. Nobody can browse these conversations in the app. Taking part is a condition of using Witness, and you agree to it during setup.

Coaching programs

A coach only sees what you choose to share: your numbers, or your numbers plus your lead chats with names and handles hidden. You can stop sharing any time, and the coach loses access right away.

Platforms

You use Witness with your own Instagram, TikTok, Facebook and LinkedIn accounts and remain responsible for following those platforms' rules. Witness is not made by, approved by or connected to Meta, Instagram, Facebook, TikTok or LinkedIn. We cannot control what those platforms decide to do with your accounts.

Fair use

When you use Witness, you agree not to:

Send spam, or use Witness to message people who asked you to stop.
Use Witness to break any platform's rules or any law.
Harass, trick or threaten anyone.
Sell, rent or give away access to Witness, or share a seat between people.
Copy, take apart or rebuild Witness, or try to get around its limits or security.
Put in data you do not have the right to use.
Overload or attack the service, or try to get into another workspace.

Beta features

Some features are marked as beta or early. They are given "as is". They may change, break or go away, and we do not promise they will work.

When we can pause or close an account

We may pause or close an account that breaks these terms, puts other users or the service at risk, or is used for spam or abuse. When we can, we will tell you first and give you a chance to fix it. For an unpaid account, we make it read-only as described above; we do not delete it.

Closing your account, and your data

Your own data (your leads, numbers and conversations) stays yours. You give us permission to store and use it only to run Witness for you. To close your account, email us at the address below. After an account closes, we keep its data for 60 days. During that time you can ask us for a copy. After that, we may delete it.

Who owns Witness

Witness, including the website, the app, the Chrome extension and everything in them, is proprietary software created and owned by Jakob Michaels through LOL Media LLC. Using Witness gives you a right to use it, not to own, copy, resell or rebuild it. Partners, coaches and anyone given access to the code or the admin side may use it only for work on Witness, and anything they add to it belongs to LOL Media LLC. Your own data (your leads, numbers and conversations) stays yours.

No promises about results

Witness is given "as is" and "as available". We work hard to keep it running and correct, but we do not promise it will always work, be free of mistakes, or get you any number of leads, booked calls or sales.

Limits on what we owe

As far as the law allows, we are not responsible for lost profits, lost sales, lost data, or indirect or special losses. That includes anything a platform does to your account. If we are found responsible for something, the most we will owe you is what you paid us for Witness in the 12 months before the problem happened.

Ohio law

These terms are under the laws of the State of Ohio, USA. Any legal case about them will be handled in the state or federal courts in Franklin County, Ohio.

Changes

If we change these terms, we will update the date at the top and tell account owners about big changes. If you keep using Witness after a change, you agree to the new terms.
